Mediation Improves Communication
Mediation is a collaborative process that helps participants move beyond fixed positions and focus on their underlying needs and interests. Rather than arguing over who is right, parties work together to better understand each other’s concerns and identify solutions that address what truly matters to them.
Mediation is Cooperative
Mediation is a process that teaches people to work together and problem solve by establishing the root issue, identifying their positions, recognizing possible solutions, and, most importantly, reminding them that the future is better when their issues are resolved.
Mediation Can Prevent
or Support Litigation
Mediation may take place before a case is filed or after a case has entered the court system. Many mediations are referred by judges during an active case. In some situations, mediation helps parties resolve the dispute entirely. In others, it narrows the issues, improves communication, or supports settlement discussions before trial.
Mediation is Confidential
Mediation sessions are confidential under Michigan law, with limited exceptions. Information shared during mediation generally cannot be used in court. However, there are specific exceptions, such as disclosures involving child abuse, threats of harm, or certain illegal activity. Mediators explain confidentiality and its limits at the start of every session.
Mediation is Impartial
Disputing parties have an equal say in the outcome of their resolution through mediation and are not found “guilty” or “innocent.” Our highly trained mediators do not impose a resolution nor decide the terms of the agreement. Try mediation and determine your own fate.
